Applications
Simon is regularly briefed to appear in the Magistrates, District and Supreme Court (as either the Respondent or the Applicant). Such applications regularly include:
Summary Judgement applications;
Setting aside Default Judgement applications;
Strike Out applications;
Statutory Demand applications; and
Injunctions.
Pleading & settling material
Simon is available to draw and/or settle pleadings, correspondence, affidavit material and written submissions. In particular, Simon has experience in pleading complex issues in banking and other lending matters involving claims based on unconscionable conduct, false and misleading representations, fitness for purpose and various breaches of the Code of Banking Practice.
Trials
Simon has conducted trials in the Queensland Civil and Administrative Tribunal, the Magistrates Court and the District Court of Queensland involving a wide range of disputes including: breach of contract; breach of lease; unconscionable conduct; false and misleading representations; and fitness for purpose. Simon also has experience in Personal Injury and Motor Vehicle Accident matters.
Mediator
Simon is an accredited mediator and available to conduct mediations or settlement conferences either online or in person.
Appeals
Simon regularly undertakes appeal work in a broad range of jurisdictions including building and construction matters.
